Late Justice Rustam Kiyani never minced words and he never hesitated to call a spade a spade. His speeches were listened to and read with rapt attention by everyone because in his time when he was judge of the High Court there was a rule by the jackboot in the country and people were afraid to criticise policies of the rulers.The speeches of Justice Kiyani were published in the form of books after his demise.They are a piece of literature too as he was a highly educated person.
Our present CJP is also following in his footsteps and he more often than not hits the nail on the head whenever he speaks on the issues confronting this country.His recent speech in a function held on the occasion of silver jubilee of the Supreme Court is thought-provoking.He said it is the judges’incompetence ‘ that is responsible for delayed justice.He also said history will not forgive the judiciary it if failed to establish its credibility.Truer words were never spoken.
He was right when he said the knowledge of judges even about basic laws was not adequate and they were getting salaries more than what officials of other government institutions received.A single judge cost the government Rs55000 per day while the delay in court proceedings had become a menace.The CJP very rightly said there was a time when lawyers used to raise their voice for truth and justice instead of defending those clients who wanted them to defend their cases by lying before courts.
Had all the state organs worked honestly and deli gently to redress the problems of the common man he would not have knocked the door of the courts but it is a pity that many state organs have failed to deliver.
