ISLAMABAD, March 30: Justice Asif Saeed Khosa of Supreme Court has remarked that judges are answerable to Allah Almighty for their decisions”.
He gave these remarks while presiding over a 3-member bench of Supreme Court (SC) during the course of hearing of appeal pleas in two separate murder cases Thursday.
The court has acquitted the one accused Abdul Baqi after eight years in a murder case at Balochistan and commuted the death sentence of second accused Munir Hussain from Punjab to life imprisonment.
The court rejected the plea from Munir Hussain seeking acquittal from the case.
During the course of hearing, Justice Asif Saeed remarked that lower courts have become fan of government. The decision will come in favor of government in any case wherein government is petitioner therein. A court has to give verdict after taking into its consideration the evidence as per law.
Justice further remarked that “Judges are also answerable to Allah Almighty for their decisions”. Prosecution considers courts as fool.
Suspect counsel said that they try to befool the courts.
Justice Khosa observed that “but two courts have become fools.”
Justice Dost remarked that recovery witness has been made eye witness. Can a recovery witness become an eyewitness? On it, counsel said this is a separate issue.
Justice Dost observed this is not a separate issue but a strange thing. Justice Khosa remarked that prosecution has completely failed to prove case against accused Abdul Baqi and the accused is acquitted due to insufficient evidences.
It is pertinent to mention here that suspect Abdul Baqi was accused in murdering a man, Ali Muhammad in Balochistan Khuda Badan, within the jurisdiction of Banjghor and trial court had awarded him death sentence while high court had commuted it into life imprisonment and now SC has acquitted him.
On the other hand, accused Munir Hussain was charged with killing a man identified as Shaukat Hayat in 2002 in the area of Sihal police station Rawalpindi, in Punjab while trial court had awarded him death sentence and high court had upheld trial court decision. Now SC has commuted his death sentence to life imprisonment.-Online
