A judge of the Peshawar High Court observed the other day that while the government has merged former FATA with the KPK,repealing the FCR,it hasn’t put in its place alternative judicial system in the tribal belt.Truer words were never spoken.It is a fact that the public opinion among the inhabitants of tribal area on this merger stands divided.A sizeable majority is averse to the very thought of policemen entering into their area.The very sight of a police man to them is like a red rag to a bull.
Lately,some policemen did try to carry out a recce of the tribal district of Mohmand for locating places for the setting up of police posts but sensing the hostile mood of the tribesmen they thought it expedient to return to Peshawar and wait for the opportune time to proceed further in the matter.It goes without saying that proper homework was not done by the powers that be before taking the decision of the afore-mentioned merger.It seems that nobody ever thought how would the police operate in many border areas of the tribal belt where even the militia or the armed forces don’t have their presence,what to speak of the police!
It is understood that due to repeal of the FCR and absence of its substitute law there has been a legal and administrative vacuum in the tribal area at the moment which is unfortunate,to say the least.Needless to say the geographical terrain of the former FATA is unique of its kind in the entire world and it is precisely for this reason that the erstwhile Britishers thought it proper to evolve an indirect system of governance.
