Seldom have the high and mighty ever got their just deserts in this country. Somehow or the other they manage to get away with their crime. They engage the highly paid lawyers with their ill_gotten money to fight legal battle in the court for them by indulging in legal nitpicking . They put to the maximum use their political clout. Experience of hindsight tells us that in nine out of ten cases they get benefit of the doubt in the courts and escape punishment.
There won’t be any let up in the crimes if the concept of award and punishment is not implemented in letter and spirit. Whatever the reasons for their acquittal , if the would-be criminals see the courts letting the guilty off the hook they are encouraged. That is why it is the cardinal principle of law that justice should not only be done it should be seen to be done. The incidence of crime has been on the increase in this country and the main reason for it is the failure of the Prosecution branch of the police to marshal its evidence correctly and forcefully in the courts of law . Had the Prosecution put in half of the effort which the defence counsels put in their attempt to save their clients from conviction there would have been a different story to tell today. It goes without saying that political expediency is also one of the main cause of poor rate of conviction in our courts. More often than not there is a lot of political interference in the investigation of the crime from the interested party in order to weaken the Prosecution case so that it should fail in trial. There is no gainsaying the fact that if the Prosecution fails to prove its case beyond reasonable doubt the courts are left with no option but to set the accused free.
